TERMS OF SERVICES

GENERAL
In order to protect you as the buyer and me as the creator, I have a set of terms of service in how I conduct business. If you have any questions, please don't hesitate to reach out.-By sending a request, I assume you have read and agreed to all my Terms of Service
-I reserve the right to decline any commission request : no clear revisions, doesn't suit my art style, etc.. (If payed =will refund)
-I reserve the right to adjust the price of any commission accordingly, However, I will never change the price of a commission that has already been previously agreed upon.
-All personal information will be kept private and confidential.
-I reserve full rights to the image and its distribution and use, unless otherwise specified.
-By commissioning me, you agree and understand that there is no physical item associated with the transaction.
✓I WILL draw: OCs, fanart. kemonomimi, furry, mecha (if simplified), armor, animals, anthro, gore (only if it's soft)
✘I WON'T draw: NSFW, lewd.
PAYMENTS & REFUNDS
-Full payment is expected upfront.
-Payment will be made via paypal only.
-If payment is still not made after 2 weeks, any commission requests will automatically be cancelled without notice.
-I reserve the right to cancel and refund a commission at any time, with prior notification to the commissioner, due to poor communication, rude/inappropriate behavior, or any kind of abuse.
-Refunds may be requested at any time by the commissioner with the following conditions : full refunds are only accepted if I haven't started the sketch yet. If the commissioner wishes to cancel a commission after the sketch part, the refunded amount will be determined by how much work has been completed.
REVISIONS
-Revisions can be made for free. No limits for the sketch phase (within reasonable limits) However, I accept only 3 minor revisions for the render phase unless I personally made a mistake based on the references. Please be detailed in your requests.
-Additional revisions/changes will be charged
DEADLINES & DELIVERY
-Timelines are subject to change due to life, please keep in mind that I am not a full-time freelancer !
-As said commissions times vary according to my availability or the commission itself. I usually take from 1 week - 1 month to finish a commission.
-I'll keep you posted on the progress of your order, but you can also check my trello, which I update regularly.
-Urgency / Deadlines: Please notify me beforehand if you need the commission done within a specific time or date. (includes an extra fee, (+80%)
USE & INTELLECTUAL PROPERTY RIGHTS
-The commissioner may only use artwork that was created specifically for them, and are for the commissioner's personal use only. This includes wallpapers, cropping the image for avatars/icons, printing the image for personal display, etc.
-The commissioner may not claim the work to be their own.
-I reserve the right to display any commissioned image(s) on any of my websites or my portfolio, except for special demands of discretion from the commissioner (vtuber debut, gift etc)
-I strictly forbid the use of my drawings to train AI's.
-I strictly forbid the use of my drawings for NFT's.
-I strictly forbid the resale of my drawing.
-If you're planning to post the art publicly, please only upload the watermarked version provided. Do not post the original file publicly.
COMMERCIAL USAGE
-The commissioner or other parties may not use the artwork for commercial, direct or indirect profit-gaining purpose without paying additional fees.
-The commercial usage = 70% of the base price. The commissioner will be able to reproduce the artwork for merchandise such as prints, charms, etc. I'd still like to be informed beforehand !

HOW TO PURCHASE ?

Fill in the form document. Take the time to detail your request and fill in all the informations requested.
Wait for me to contact you back by e-mail or by the messaging service of your choice that you will have specified in the google form. You can expect a reply within 1 week. (If I still haven't contacted you within that time, try my discord messaging service)
If I accept your order, I'll send you your invoice and your order number at the same time. You can then proceed to payment. (Payment can only be made via paypal.)
You can now see your order in the waitlist on my trello. When I start working on your order, you'll be notified and I'll send you sketchs and progress report so you can give me feedback.
Your commission is finished ! I'll send you the different files of your order in our conversation thread via we-transfer to keep the quality of the work optimal. Please be sure to keep your order files somewhere same, as I will only keep them for 2 years in my professional files, after which time I will delete them.

GÉNÉRAL
Afin de vous protéger en tant qu'acheteur et moi en tant qu'artiste, j'ai un ensemble de conditions de service dans la façon dont je conduis les affaires. Si vous avez des questions, n'hésitez pas à me contacter.-En envoyant une demande, je pars du principe que vous avez lu et accepté toutes mes conditions d'utilisation.
-Je me réserve le droit de refuser toute demande de commission : pas de révisions claires, ne correspond pas à mon style artistique, etc.
-Je me réserve le droit d'ajuster le prix de toute commande en conséquence. Cependant, je ne changerai jamais le prix d'une commande qui a déjà fait l'objet d'un accord préalable.
-Toutes les informations personnelles seront gardées privées et confidentielles.
-Je me réserve tous les droits sur l'image et sa distribution et son utilisation, sauf indication contraire.
-En me passant commande, vous acceptez et comprenez qu'il n'y a pas d'objet physique associé à la transaction

PAIEMENTS & REMBOURSEMENTS
-Le paiement intégral est attendu à l'avance.
-Le paiement sera effectué via paypal uniquement.
-Si le paiement n'est toujours pas effectué après 2 semaines, toute demande de commission sera automatiquement annulée sans préavis.
-Je me réserve le droit d'annuler et de rembourser une commission à tout moment, avec notification préalable au client, en raison d'une mauvaise communication, d'un comportement grossier/inapproprié ou de tout type d'abus.
-Les remboursements peuvent être demandés à tout moment par le client aux conditions suivantes : les remboursements complets sont uniquement acceptés si je n'ai pas encore commencé le sketch de sa commande. Si le commanditaire souhaite annuler une commande après la partie esquisse, le montant remboursé sera déterminé en fonction de la quantité de travail déjà accomplie.
RÉVISIONS
-Les révisions peuvent être effectuées gratuitement. Il n'y a aucune limite de révisions pendant la phase du sketch (dans des limites raisonnables) Cependant, je n'accepte que 3 révisions mineures pour la phase de rendu final, à moins que je n'aie personnellement commis une erreur en me basant sur les références. Merci d'être précis dans vos demandes.
-Les révisions/changements supplémentaires passé la phase de sketch seront facturés.
DÉLAIS & ÉCHÉANCES
-Les délais sont susceptibles de changer, veuillez garder à l'esprit que je ne suis pas en freelance à plein temps !
-Les délais varient en fonction de ma disponibilité ou de la commande elle-même. Il me faut généralement entre 1 semaine et 1 mois pour terminer une commande.
-Je vous tiendrai au courant de l'avancement de votre commande, mais vous pouvez également consulter mon trello, que je mets à jour régulièrement.
-Urgence / Délais: Veuillez m'informer à l'avance si vous avez besoin que la commission soit réalisée dans un délai ou une date spécifique. (inclut des frais supplémentaires, (+80%)).
UTILISATION & PROPRIÉTÉ INTELLECTUELLE
-Le client ne peut utiliser son dessin que pour lui et pour son usage personnel.
-Le client ne peut pas revendiquer le travail comme étant le sien.
-Je me réserve le droit d'afficher toute(s) image(s) commandée(s) sur n'importe lequel de mes sites web ou de mon portfolio, sauf en cas de demande spéciale de discrétion de la part du commanditaire (début de vtuber, cadeau, etc.).
-J'interdis strictement l'utilisation de mes dessins pour train des IA.
-J'interdis strictement l'utilisation de mes dessins pour des NFT.
-J'interdis formellement la revente de mes dessins.
-Si vous avez l'intention de publier le dessin, veuillez utiliser uniquement la version signée fournie. Ne publiez pas le fichier original.
USAGE COMMERCIAL
-Le client ou d'autres parties ne peuvent pas utiliser le dessin à des fins commerciales, directes ou indirectes, sans payer des frais supplémentaires.
-L'utilisation commerciale = 70% du prix de base. Le client pourra alors reproduire le dessin pour des marchandises telles que des prints, des porte-clefs... etc. J'aimerais tout de même être informé au préalable !

Si j'accepte votre commande, je vous enverrai votre facture et votre numéro de commande en même temps. Vous pourrez ainsi procéder au paiement. (Le paiement est uniquement via paypal.)
Vous pouvez maintenant voir votre commande dans la liste d'attente sur mon trello. Lorsque je commencerai à travailler sur votre commande, vous en serez informé et je vous enverrai des croquis et des updates de l'avancée de celle-ci afin que vous puissiez me faire vos retours.
Votre commande est terminée ! Je vous enverrai les différents fichiers de votre commande dans notre fil de conversation via we-transfer afin de garder la qualité du travail optimale. Veillez à conserver les fichiers de votre commande dans un endroit sécurisé, car je ne les conserverai que pendant 2 ans dans mes fichiers professionnels, après quoi je les supprimerai.
